Terms of Service
The agreement between you and Docuplate for using Docuplate in Australia.

1. Agreement
By creating an account, accessing the website, or using our API, you agree to these Terms of Service and our Privacy Policy. If you use the service on behalf of an organisation, you represent that you have authority to bind that organisation.
These Terms are governed by the laws of Australia. If you acquire services as a consumer, you have rights under the Australian Consumer Law that cannot be excluded (see section 10).
2. The service
Docuplate provides tools to design PDF templates, generate PDFs from JSON data, manage API keys, and (on eligible plans) use AI-assisted features. Features and limits depend on your subscription plan. We may modify, suspend, or discontinue features with reasonable notice where practicable.
3. Accounts and security
- You must provide accurate registration information and keep credentials confidential.
- You are responsible for all activity under your account and API keys.
- Notify us promptly at [email protected] if you suspect unauthorised access.
- We may suspend accounts that violate these Terms or pose a security risk.
4. Your content and data
You retain ownership of templates, JSON payloads, and PDFs you submit. You grant us a limited licence to host, process, transmit, and display your content solely to provide and improve the service (including PDF rendering, backups, and support).
You are solely responsible for the legality, accuracy, and appropriateness of content you upload or generate, including personal information about your customers or employees. You must comply with the Privacy Act 1988 (Cth) and other applicable Australian law when processing personal information through the service.
5. API access
API keys are confidential credentials. You must not embed keys in client-side code, public repositories, or untrusted environments. API usage is subject to rate limits, plan quotas, and technical restrictions documented in our guides. Misuse may result in throttling or key revocation.
6. Subscriptions, GST, and payment
Paid plans are billed through Stripe on a recurring basis unless cancelled. Prices are shown in US dollars (USD) unless otherwise stated. GST applies to Australian customers where required by law and will be included or added at checkout as applicable.
You may cancel via the in-app billing flow; cancellation generally takes effect at the end of the current billing period. Refunds are provided only where required by the Australian Consumer Law or explicitly offered by us in writing.
Free tiers and trials may change or end. We may update pricing with reasonable advance notice for renewing subscriptions.
7. Acceptable use
You must comply with our Acceptable Use Policy and all applicable Australian laws. Prohibited conduct includes illegal activity, malware distribution, harassment, infringing intellectual property, attempting to bypass security, and excessive automated abuse of the API.
8. Our intellectual property
The service, software, branding, and documentation (excluding your content) are owned by Docuplate or its licensors. These Terms do not grant you any right to our trademarks or to copy our software except as needed to use the service as intended.
9. Service disclaimers
Except as set out in section 10, and to the extent permitted by law, the service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or perfectly accurate PDF output. AI-generated suggestions are advisory only and should be reviewed before reliance.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). For major failures, you are entitled to cancel a service contract and obtain a refund for the unused portion, or compensation for the drop in value. You are also entitled to have services supplied within a reasonable time when no time is set.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law. For non-consumer business users, liability for breach of a non-excludable guarantee may be limited, where permitted by law, to resupply of the services or payment of the cost of having the services supplied again.
Consumer enquiries may also be directed to the Australian Competition and Consumer Commission (ACCC).
11. Limitation of liability
To the extent permitted by law (and subject to section 10), Docuplate and its suppliers are not liable for any indirect, incidental, special, or consequential loss, or loss of profits, revenue, data, or goodwill, arising from your use of the service.
To the extent permitted by law, our total liability for any claim arising from these Terms or the service will not exceed the greater of (a) amounts you paid us in the twelve months before the claim or (b) AUD $100.
12. Indemnification
You agree to indemnify Docuplate against claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service, violation of these Terms, or violation of third-party rights, except to the extent caused by our wrongful act or omission.
13. Termination
You may stop using the service at any time. We may suspend or terminate access for breach, risk, non-payment, or prolonged inactivity. Upon termination, your right to use the service ends. Sections that by nature should survive (including liability limits, indemnity, and governing law) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia.
If a dispute arises, contact us at [email protected] first. We will try to resolve it in good faith. Nothing in this section limits your rights under the Australian Consumer Law.
